National Executive Meeting of the All India Judicial Employees Confederation (AIJEC) Concludes Successfully

Key Resolutions Passed on Equal Pay for Equal Work, Full Implementation of the Justice Shetty Commission Recommendations, Constitution of a National Judicial Employees Commission, and Protection of Judicial Employees

The National Executive Committee Meeting of the All India Judicial Employees Confederation (AIJEC) was successfully held today at the India International Centre Annexe, New Delhi, under the chairmanship of the National President, Shri Raju Bhai Brahmbhatt.

The meeting was attended by Patron Shri B. Lakshma Reddy, Senior Vice President Shri Naresh Chauhan, General Secretary Shri H. A. Nagesh, Organising Secretary Shri Rajeshwar Tiwari, Treasurer Shri Manish Kapadia, along with State Presidents, General Secretaries, and representatives from all States and Union Territories across the country. Representatives from Jammu & Kashmir to Kanyakumari actively participated and presented their valuable views and suggestions on various pressing issues concerning judicial employees.

The Executive Committee expressed deep concern over the long-standing issues faced by judicial employees, including pay disparities, anomalies in pay revision, inequality in promotional opportunities, neglect of service conditions, and the lack of adequate service benefits and facilities.

The representatives observed that even after 23 years, judicial employees have not received the full benefits of the recommendations of the Justice Shetty Commission, despite the Commission having been constituted pursuant to the directions of the Hon'ble Supreme Court of India and the Supreme Court having issued clear directions for the implementation of its recommendations.

The meeting further noted that when the recommendations of the Justice Shetty Commission were originally due for implementation, the Fifth Central Pay Commission was in force. Today, the country is on the verge of implementing the Eighth Pay Commission, yet the fundamental issues affecting judicial employees remain unresolved. The Executive Committee described this situation as highly unfortunate and unjust to judicial employees.

The National Executive Committee unanimously resolved to take effective steps before the Hon'ble Supreme Court of India for the early hearing and expeditious disposal of Civil Writ Petition (Civil) No. 1040 of 2017, which seeks "Equal Pay for Equal Work" and Uniform Designation for judicial employees throughout the country.

The Executive Committee also unanimously demanded the constitution of an Independent National Judicial Employees Commission, on the lines of the commissions constituted for judicial officers. The proposed Commission should ensure:

Uniform Pay Scales

Uniform Designations

Uniform Service Rules

Uniform Promotion Policy

Uniform Service Benefits for Judicial Employees across India

The Committee also expressed serious concern over the increasing mental stress, excessive workload, shortage of staff, and adverse working conditions prevailing in the judicial establishment. It was observed that the incidents of suicide by judicial employees reported from different States are a matter of grave concern and a warning for the entire judicial system.

To prevent such tragic incidents, the Executive Committee demanded:

Adequate recruitment of judicial employees;

Balanced distribution of workload;

Time-bound promotions;

Removal of pay anomalies;

Access to mental health counselling and support services; and

A safe, healthy, and dignified working environment.

The National Executive Committee urged the Government of India, all State Governments, and all High Courts to resolve the long-pending issues of judicial employees at the earliest and to recognize judicial employees as an indispensable pillar of the justice delivery system by ensuring fairness and justice in their service conditions.

The Executive Committee expressed confidence that the Hon'ble Supreme Court of India, the Government of India, and all State Governments would take a positive view of these legitimate demands and provide long-awaited relief to millions of judicial employees across the country.
